2. The Monaco Trademark Law and its Implementing Regulations came into effect in October 1983. Adopting the principle of prior use, the first user has the right to register and exclusive ownership.
3. The Monaco trademark is managed by the Monaco Patent Office and the official language is French.
4. Trademark type
① Text trademark: can be in Chinese, English, French or other languages, but cannot be in Chinese pinyin, numbers or English letters.
② Graphic trademark: It can be a three-dimensional graphic or a combination of colors, but it must have distinctive features.
③ Sound trademark: It needs to be notarized to prove the legality of its sound, and then submitted to the Monaco Trademark Office for registration.
④ Digital trademarks must be based on English letters, and if the applicant wishes to use numbers in the application, their legality must be proven through notarization.
Monaco is a contracting party to international intellectual property treaties such as the WIPO Convention, Paris Convention, Nice Agreement, Vienna Agreement, and is also a member of the Madrid Agreement and Madrid Protocol. Therefore, trademark registration in Monaco can be processed through "single country registration" or "Madrid international registration".
The trademark is valid for 10 years from the date of application; Renewal can be processed within 6 months before the expiration date, with a grace period of 6 months (with additional fees) and a validity period of 10 years.

If priority is declared, proof of priority must be provided.
The trademark applicant shall submit the trademark application documents to the Industrial Property Office. If the procedures are incomplete, it shall be supplemented within 3 months after the application is submitted. If any non-standard documents are found during the formal examination, the competent authority shall notify the applicant by registered mail, and the applicant shall complete the modifications within 8 working days. If the modifications cannot be completed on time, the trademark application documents shall become invalid.
The trademark that has passed the formal examination enters the substantive examination, which examines whether the trademark has registrability and complies with the provisions of Monaco's trademark law. For trademark documents that do not comply with the regulations, the trademark registrar will notify the applicant, and the applicant must complete the modification of the problematic documents within the prescribed time. If the modification is not made within the prescribed time, it will be deemed as giving up the trademark documents;
The trademark documents that comply with the regulations will be published in the official trademark announcement of Monaco. Anyone can raise objections to the trademark documents during the announcement period. After the objection ruling or the absence of objections during the announcement period, the trademark will be approved for registration and a trademark registration certificate will be issued.
