Slovenia's industrial property law was born on March 20, 1992 and came into effect on April 4, 1992. The law was amended on May 29, 1993, and the supplementary law came into effect on June 13, 1993. This law includes provisions for patents, trademarks, place of origin names, utility models, and designs. The new Industrial Property Law came into effect in 2001.
2. Trademark ownership is obtained through registration, and applications can be made to register commodity trademarks, service trademarks, and collective trademarks. Slovenia adopts the International Classification of Goods and Services for trademark registration.
3. The trademark system has a multi class application system.
4. The official language is Slovenian.
Slovenia is a party to international intellectual property treaties such as the WIPO Convention, the Paris Convention, the Nice Agreement, the Trademark Law Treaty, and the Nairobi Treaty. It is also a member of the European Union and a member of the Madrid Agreement and Madrid Protocol. Therefore, trademark registration in Slovenia can be processed through "single country registration", "EU registration", or "Madrid International Registration".
The trademark is valid for 10 years from the date of application, and can be renewed within 12 months before the expiration date. The extension period is 6 months, and the renewal period is 10 years.
According to the provisions of the Madrid Agreement on the International Registration of Trademarks and the relevant Protocol to the Madrid Agreement on the International Registration of Trademarks, the process of trademark registration among the member countries of the Madrid Union is divided into application preparation, payment of fees and certificate collection. The relevant application documents that should be submitted for application preparation are as follows:
Firstly, the enterprise needs to fill out a Chinese international registration application with official seal and a foreign international registration application with official seal or signature;
Secondly, the enterprise needs to provide two trademark designs;
If it is a colored trademark, two colored trademark designs must also be attached;
If a trademark agency is entrusted to handle it, a trademark agency power of attorney should be submitted.
If applying from a single country, the following materials should be prepared:
Applicant's name and address;
Categories that require protection;
Product and service names;
Trademark design;
Signed Trademark Authorization Letter.
Submit application documents to the Slovenian Intellectual Property Office;
The examiner will conduct a formal and substantive examination of the application to confirm whether the application documents are complete and whether the applied trademark meets the basic registration requirements; If the review fails, a rejection notice will be issued and a response will be required within the specified time;
Once the review is approved, an announcement will be arranged, and the objection period will be 3 months from the announcement date;
Approval and Certification: If there are no objections or objections are not valid during the announcement period, the trademark will be approved for registration and a trademark registration certificate will be issued to the applicant.
If everything goes smoothly, trademark registration in Slovenia takes approximately seven to twelve months. If there are situations such as trademark rejection or opposition, the time will be correspondingly extended.
