Due to Anguilla being a British Overseas Territory, there are two ways to register local trademarks: either by directly applying for registration protection with the local trademark registration office, or by extending protection based on a UK registration request.
The Anguilla trademark is valid for 10 years after registration, starting from the date of application; Renewal can be processed within 6 months before the expiration date, with a grace period of 6 months; The renewal is valid for 10 years. If a trademark is not used continuously for at least 5 years after registration, anyone can apply for revocation.
1. Trademark design;
2. Category and specific product/service items;
3. Name and address of the applicant;
4. The power of attorney needs to be notarized;
5. If it is an extension of a UK trademark, a certified copy of the UK registration certificate is required;
6. If priority is declared, proof of priority and corresponding English translation must be provided.
After the trademark application is submitted, formal examination and substantive examination (including relative and absolute reasons) shall be conducted. If there are no reasons for rejection, the trademark application shall be published in the intellectual property announcement for a period of one month. After the expiration of the announcement period, if no one raises any objections to the trademark application, the trademark application will be approved for registration.
If everything goes smoothly, the entire process will take about 4 months to complete.
